Welcome to Wise Wombat, a product offered by
Telepat.io, Inc., a Delaware corporation with headquarters at
201 Spear Street, San Francisco, CA 94105 (”Telepat.io”,
“we”, “us”, or “our”). These Terms of Service
(”Terms”) govern your access to and use of our websites, mobile
applications, and related products or services (collectively, the
“Service”). Please read them carefully.
By accessing or using the Service, you agree to be bound by these
Terms and our Privacy Policy. If you do not agree with any part of
these Terms, you must not access or use the Service.
1. Service Overview
Wise Wombat is a SaaS platform designed to help users identify and
engage with potential leads by scanning public conversations on social
networks and forums. The platform uses AI-driven analysis and
intelligent filters to identify individuals who may be expressing
interest, intent, or need relevant to your business offerings.
The Service is intended for use by professionals, businesses, and
organizations seeking to generate leads in a compliant and ethical
manner. By using the Service, you acknowledge and accept that your
results may vary and depend on factors outside of Telepat.io’s
control, including network access, third-party platform availability,
and your own outreach strategies.
2. Eligibility and Access
To use the Service, you must be at least 18 years old and capable of
entering into a legally binding agreement under applicable law. By
registering or using Wise Wombat, you represent and warrant that you
meet these eligibility requirements.
If you are accessing the Service on behalf of an organization, you
represent that you have authority to bind that entity to these Terms.
In such cases, “you” and “your” will refer to both you as an
individual and the organization you represent.
3. Account Creation and Security
Access to the full functionality of Wise Wombat requires the creation
of a user account. When registering, you agree to provide accurate,
complete, and up-to-date information. You are responsible for
safeguarding your account credentials and for any activities that
occur under your account, whether or not authorized by you.
You must notify us immediately of any unauthorized use or suspected
breach of your account. We reserve the right to suspend or terminate
accounts found to be in violation of these Terms or involved in
suspicious activity.
4. Permitted Use and Restrictions
You agree to use the Service only for lawful, authorized purposes and
in accordance with these Terms. You may not use the Service:

users interact with Wise Wombat. This helps us monitor system

However, by using the Service, you grant Telepat.io a limited,
non-exclusive, royalty-free license to process, store, reproduce, and

Service.
You are solely responsible for ensuring that your content complies
with applicable laws and does not infringe the rights of any third
party.
7. Third-Party Platforms and Integrations
Wise Wombat interacts with publicly available data on third-party
social networks and platforms (e.g., Reddit, LinkedIn, Twitter). While
we comply with the terms of service and public API policies of these
platforms, Telepat.io is not affiliated with or endorsed by any third
party unless explicitly stated.
Your use of data obtained through Wise Wombat remains your
responsibility, including ensuring that any outreach or follow-up
actions comply with local laws, anti-spam regulations, and the terms
of the platforms you engage with.
8. Service Availability and Modifications
We strive to provide a reliable and responsive service. However, we
do not guarantee uninterrupted or error-free operation. From time to
time, we may suspend access to the Service for maintenance, upgrades,
or other reasons beyond our control.
We reserve the right to modify, update, or discontinue the Service or
any part of it at any time, with or without notice. In such cases, we
are not liable for any loss resulting from changes in availability or
performance.
9. Termination and Suspension
You may cancel your account at any time by contacting us or using the
account management features provided. Telepat.io reserves the right to
suspend or terminate your access to the Service at our discretion,
including for violations of these Terms, non-payment of fees, or use
of the Service in a harmful or unlawful way.
Upon termination, your right to use the Service will immediately
cease, and we may delete associated data unless legally required to
retain it.
10. Intellectual Property
All rights, title, and interest in and to the Service (excluding
user-submitted content) are and will remain the exclusive property of
Telepat.io, Inc. and its licensors. This includes all software,
trademarks, content, and branding elements.
You may not use the Telepat.io or Wise Wombat names, logos, or other
proprietary marks without prior written permission.
11. Disclaimer of Warranties
The Service is provided on an “as-is” and
“as-available” basis without any warranties, express or
implied. We do not warrant that the Service will be accurate,
reliable, secure, or free of defects or harmful components.
To the fullest extent permitted under applicable law, Telepat.io
disclaims all warranties, including merchantability, fitness for a
particular purpose, and non-infringement.
12. Limitation of Liability
To the extent permitted by law, Telepat.io shall not be liable for
any indirect, incidental, special, consequential, or punitive damages,
or any loss of profits or revenue, whether incurred directly or
indirectly, arising from your use of the Service.
Our total liability for any claim under these Terms shall not exceed
the amount you paid us in the 6 months prior to the event giving rise
to the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless Telepat.io and its
affiliates, directors, officers, employees, and contractors from and
against any claims, liabilities, damages, losses, and expenses arising
from:

14. Governing Law and Dispute Resolution
These Terms and any related disputes shall be governed by the laws of
the State of California, without regard to its conflict of law
principles. Any legal action must be brought exclusively in the state
or federal courts located in San Francisco, CA.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in
legal, technical, or business conditions. When we make material
changes, we will provide notice through the Service or via email.
Continued use of the Service after such notice constitutes your
acceptance of the updated Terms.
